Bombay High Court Allows a Student with Online Gaming Disorder to Take the Improvement Exams in July 2024

The Bombay High Court has allowed a 19-year-old boy with an Online Gaming Disorder to retake his Class XII improvement exams. Delivered on July 4 by a division bench of Judges A S Chandurkar and Rajesh Patil, this landmark decision offers opportunities to students dealing with gaming disorder, or any other sorts of medical challenges.

As reported by the Times of India, the boy was an above-average student in his class and used to score between 85-93% marks when studying in Class XI. However, his mark gradually dropped in Class XII when he scored 316 marks out of 600. 

From July 2023 to December 2023, he underwent treatment for depression and anxiety at the Bhabha Atomic Research Centre Hospital. The student could not sit for the re-examination held in July 2023 because of his condition. 

He tried to obtain permission to take the improvement exams in March 2024, but the college denied his request, leading him to seek help from the Bombay High Court.

After reviewing the medical records and considering the circumstances of the case, the High Court verified the authenticity of the documents and concluded that the student genuinely could not sit for the exam because of medical reasons. Therefore, granting the petitioner to retake the examination commencing on July 14, by paying the necessary late fees. 

The court ordered “In the interest of justice, subject to the petitioner making the requisite application seeking permission to appear in the July 2024 examination with the College, coupled with payment of necessary late fees, he shall be permitted to appear in the July 2024 examination that is to commence from 16th July 2024.
